Legal
Terms
Effective 16 October 2026.
Pillwise is operated by Solemark LLC. By using the site or API you agree to these terms. If you enable Cabinet, the BAA also applies and controls on PHI.
The service
Index is a hosted US medication catalog. We do not practice medicine. We do not score drug–drug interactions in this version. You are responsible for how you display answers in your product.
Plans and meter
Included lookups are a block for a period. Exhaustion follows the published grace then 402. When a card is on file, running out buys another monthly block at your plan’s rate. Custom volume is invoice only. Cancelling and refunds are covered in Cancellation and refunds.
Acceptable use
No resale of the raw Index as a competing catalog. No attempting to deanonymize tokenized member ids. No scraping the website to rebuild the API.
Disclaimer of warranties
Pillwise is provided “as is” and “as available”. Solemark makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, except those stated in these terms or the BAA.
Index is reference data compiled from government and other third-party sources. Those sources can be incomplete, delayed, or wrong, and we do not warrant that Index is complete, current, or error-free. Pillwise is not medical advice. You are responsible for how your product uses and displays it, and for any clinical, coverage, or dispensing decision made with it. We do not warrant that Pillwise will be uninterrupted or free of errors.
Limitation of liability
No indirect damages. Neither party is liable to the other for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, goodwill, or data, even if told they were possible. Data Breach Costs, below, are not excluded by this paragraph.
General cap. Each party’s total liability arising out of or relating to these terms, the BAA, and Pillwise is limited to the fees you paid to Solemark for Pillwise in the 12 months before the event giving rise to the claim. If you use only the free sandbox, the cap is US $100.
Data breach cap. For Data Breach Costs, Solemark’s total liability is instead limited to three times (3×) the fees you paid to Solemark for Pillwise in the 12 months before the Breach. This cap replaces the general cap for those costs; the two caps are not added together.
“Data Breach Costs” means your reasonable, documented costs that result from a Breach of Unsecured Protected Health Information, as defined in the BAA, caused by Solemark’s breach of the BAA. They are limited to: notifying affected individuals, regulators, and the media as the law requires; call-center support for affected individuals; credit monitoring for affected individuals for up to one year; forensic investigation of the Breach; and fines and penalties imposed by a regulator, to the extent caused by Solemark’s breach.
Exceptions. These limits do not apply to a party’s fraud or willful misconduct, or to your obligation to pay fees owed.
Basis of the bargain. These limits apply whatever the legal theory, whether contract, tort (including negligence), or otherwise. They are an essential part of the bargain between the parties, and prices reflect them.
